High Court throws out WYD funding challenge

The High Court has refused to hear a challenge to the constitutional legality of the Federal Government spending $22 million on Catholic World Youth Day (WYD).

Carmelo Vescio wanted to challenge the constitutional legality of the Federal Government contributing $22 million to July's papal mass and Catholic World Youth Day.

His claim was based on the constitutional ban on imposing religious observance or preventing the free exercise of any religion.

Justice Caroline Crennan ruled that the arguments were political rather than legal and refused to accept the claim, saying that any case would be an abuse of process.

Today an application to appeal was dismissed, two judges agreeing that the case would be vexatious.

Justice Michael Kirby dissented, saying Mr Vescio deserved his day in court.
